Mosyon ni Gobernador Cagas gibasura sa Comelec
DAVAO DEL SUR - Ang Commission on Election (Comelec) first division mibasura sa “motion for reconsideration” sa desisyon niin nga gipasaka ni Davao del Sur Governor Douglas Cagas.Sunday, February 5, 2012
Ang Comelec nagmando nga ihapon ang tanang balota sa miaging piliay human nagprotesta si kanhi 2nd District Representative Claude Bautista.
Sa resolusyon nga gipaguwa sa Comelec Manila nga nahuptan sa Superbalita, ang Comelec nagmando nga ipadala sa kauluhan ang 80 porsyento nga nahibiling ballot boxes sa lalawigan.
Subay sa maong resolusyon, nasuta sa Comelec nga adunay unod ang petisyon ni Bautista human napamatud-an nga ang naunang 20 porsyento adunay mga kwestyonableng balota.
Si Presiding Commissioner Rene Sarmiento maoy mibasura sa mosyon ni Cagas.
"While protestee raised several issues in his motion for reconsideration it can summarized into one because Cagas argued that the commission (first division) committed reversible error when it ruled based on the initial findings of the recount committees," matud ni Sarmiento.
"After conducting the recount, the committee found some irregularities from the 20 percent of the protested clustered precincts and decided that recount proceedings to continue," dugang niya.

"Protestee argued that first division erred in finding, based on the results of the initial proceedings, the protest filed by Bautista should proceed," dason ni Sarmiento.

Si Attorney Maria Febes Barlaan, provincial election supervisor, nagsulti nga sugod karong adlawa ilang kuhaon ang 80 porsyento o 575 ballot boxes sa aron dalhon sa kauluhan.
Giproklamang midaug si Cagas pagka-gobernador sa botong 163,440 batok ni Bautista nga nakakuha lamang og 159,527 nga boto atol sa 2007 election.
Apan nasuta sa kampo ni Bautista nga adunay nahitabong pagpanikas hinungdan nga napildi siya mao nga nagpasaka sila og electoral protest didto sa Comelec Manila niadtong Mayo 24, 2010.
